Most US green cards for workers need an employer to sponsor you. The EB-2 National Interest Waiver (NIW) is different. If your work benefits the United States, you can file the petition yourself, without a job offer or labour certification.
Who can qualify
First you must qualify for EB-2. That means either an advanced degree (master’s or higher, or a bachelor’s plus five years of progressive experience) or exceptional ability in your field. Then USCIS applies a three-part test:

- Your proposed work has substantial merit and national importance.
- You are well positioned to advance it, based on your education, record, plans and progress.
- On balance, it would benefit the US to waive the job-offer requirement.
Fields where NIW is common
STEM research, engineering, healthcare, public health, artificial intelligence, energy and entrepreneurs with a credible US business plan.
Evidence that tends to help
- Publications, citations, patents or products used by others.
- Recommendation letters from independent experts, not just colleagues.
- Evidence of funding, awards, media coverage or government interest in your work.
- A clear, specific plan for what you will do in the US.
Timing and limits
Approval of the petition (Form I-140) does not give you a green card straight away. You still wait for a visa number under the monthly Visa Bulletin, and some countries have long backlogs.
Note for Nigerian applicants: since 1 January 2026, a US presidential proclamation has suspended most immigrant visas (green cards processed at an embassy) and B, F, M and J visas for Nigerian nationals who were outside the US without a valid visa on that date, with limited exceptions. Temporary work visas such as H-1B are not on the suspended list, but consulates may issue them with shorter validity. Check the latest guidance from the US Embassy in Nigeria before you pay for anything.
Because the NIW is evidence-heavy, many applicants use an immigration attorney. Check that any lawyer is licensed by a US state bar.
Frequently asked questions
Do I need a job offer for NIW?
No. That is the main advantage. You file Form I-140 yourself.
Can I file NIW from outside the US?
Yes, you can file the petition from abroad. You would then complete the process through an immigrant visa at a US embassy, which is currently suspended for most Nigerian nationals.
How long does approval take?
Petition processing times vary. Premium processing is available for an extra fee and speeds up the decision on the petition only, not your place in the visa queue.
Information checked in October 2026. Immigration rules change often, so always confirm the latest requirements on the official government website before applying or paying any fees.
